The type of personal information we collect

We collect and process the following information:

  • your name and contact information, including addresses, email addresses and telephone numbers;
  • information to enable us to check and verify your identity, e.g. your date of birth, as well as identity documents such as passports which may contain biometric data or data revealing racial or ethnic origin;
  • your gender information;
  • your billing information, transaction and payment card information;
  • information about your business(es);
  • details of your assets and financial position.

This personal information is required to provide legal services to you. If you do not provide personal information we ask for it may delay or prevent us from providing legal services to you.

We will keep your personal information while we are providing legal services to you. Thereafter, we will keep your personal information for as long as is necessary to:

  • respond to any questions, complaints or claims made by you or on your behalf;
  • show that we treated you fairly;
  • keep records required by law.

We will not retain your personal information for longer than necessary for the purposes set out in this notice. Different retention periods apply for different types of personal information. Further details on this aspect are available on request.

How we get the personal information and why we have it

Most of the personal information we process is provided to us directly by you as a result of you instructing us to provide legal services. We collect most of this personal information directly from you – in person, by telephone, text or email and/or via our website.

We may also collect information from:

  • publicly accessible sources, e.g. Companies House or HM Land Registry;
  • a third party directly, e.g. the Crown Prosecution Service.
  • a third party with your consent, e.g. your doctor.

We use the information you provide primarily for the provision of legal services to you, but also for the following reasons:

  • compliance with our legal and regulatory obligations;
  • fraud prevention;
  • updating and enhancing client records;
  • analysis to help us manage our practice;
  • statutory returns;
  • preventing unauthorised access and modifications to systems;
  • external audits and quality checks, e.g. for Specialist Quality Mark (SQM), The Legal Aid Agency and the audit of our accounts.

We may share this information with:

  • third parties we use to help deliver our legal services to you, e.g. barristers and other experts;
  • other third parties we use to help us run our business, e.g. website hosts;
  • due diligence providers;
  • our insurers and brokers;
  • our bank;
  • law enforcement agencies and regulatory bodies to comply with our legal and regulatory obligations.

Under the UK General Data Protection Regulation (UK GDPR), the lawful bases we rely on for processing this information are:

  • necessary for the performance of a contract;
  • consent;
  • legitimate interests.

How we store your personal information

Your information is securely stored.

We will keep your personal information while we are providing legal services to you. Thereafter, we will keep your personal information for as long as is necessary to:

  • respond to any questions, complaints or claims made by you or on your behalf;
  • show that we treated you fairly;
  • keep records required by law.

Your data protection rights

Under data protection law, you have rights including:

Your right of access - You have the right to ask us for copies of your personal information.

Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.

Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.

Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances.

Your right to object to processing - You have the the right to object to the processing of your personal information in certain circumstances.

Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
